These Terms of Service (the “Terms”) govern your use of shopwindowwells.com and your purchase of products from Shop Window Wells. By using this site or placing an order, you agree to these Terms. Please read them before you buy.

1. Who we are

Shop Window Wells manufactures and sells steel window wells, covers and related products from our plant at 7042 30 St SE, Calgary, Alberta T2B 0P1, Canada. You can reach us at info@shopwindowwells.com or (403) 972-0988. In these Terms, “we”, “us” and “our” mean Shop Window Wells; “you” means the person using the site or placing an order.

2. Eligibility

You must be the age of majority in your province or territory to place an order. By ordering, you confirm that you are, and that the information you give us is accurate and complete.

3. Products, descriptions and photographs

We work hard to describe our products accurately, but please note:

  • Product photographs are illustrative. Finish, colour and appearance can vary between screens and between production runs, particularly on galvanized steel, where surface spangle and sheen naturally differ.
  • Stated dimensions are nominal and subject to normal manufacturing tolerances.
  • We may correct errors or inaccuracies in descriptions, pricing or availability at any time, including after an order has been submitted.

4. Measuring, fit and suitability — your responsibility

You are responsible for choosing the right product for your opening and your site. This includes measuring your window, your foundation and the excavation, and confirming that the size you order will fit and perform as you intend. If you are not certain, contact us before ordering — we would rather help you choose than process a return.

5. Building codes and egress

Any information we publish about egress requirements, including references to the National Building Code, is provided for general guidance only. It is not a code interpretation, an engineering opinion, or a guarantee that a given product will satisfy the requirements applicable to your project.

Provincial and municipal amendments vary, and the requirements that apply to your property are determined by your local authority. You and your contractor are responsible for confirming compliance with your building department before you purchase and install.

6. Installation and safety

We manufacture and supply products; we do not install them. Installation should be carried out by a competent person familiar with excavation, drainage and foundation work.

Steel window wells and covers are heavy, bulky and have sharp edges. Handle them with gloves and adequate help. Excavation adjacent to a foundation carries risk of collapse, and buried utilities must be located before you dig. We accept no responsibility for injury, property damage or code violations arising from installation.

7. Orders and acceptance

Your order is an offer to purchase. A confirmation email acknowledges that we received it; it does not constitute acceptance. A contract forms only when we dispatch the goods or confirm that your order is ready for collection.

We may decline or cancel an order, in whole or in part, including where the product is unavailable, where there has been an error in the price or description, where we cannot deliver to your address, or where we suspect fraud. If we cancel an order you have paid for, we will refund you in full.

8. Prices, payment and taxes

All prices are in Canadian dollars and exclude applicable taxes and shipping unless stated otherwise. Prices may change at any time before you place an order. Applicable GST, HST or provincial sales tax is calculated and shown at checkout based on your delivery address.

Payment is due in full at checkout. We accept the payment methods shown at checkout.

If a product is listed at an incorrect price because of a typographical or system error, we may cancel the order and refund you, even if the order has been confirmed.

9. Shipping, delivery and risk

Shipping costs, lead times, transit estimates and what to expect on delivery day are set out in our Shipping Policy, which forms part of these Terms.

Delivery dates are estimates and are not guaranteed. Risk of loss or damage passes to you on delivery, or on collection if you pick up your order. Damage in transit must be recorded on the delivery receipt before you sign and reported to us within 48 hours, as described in our Shipping Policy.

10. Returns

Returns are governed by our Return Policy, which forms part of these Terms.

11. Defective products

If a product has a defect in materials or workmanship, contact us with your order number and photographs and we will repair, replace or refund it. This is in addition to any rights you have under applicable consumer protection legislation.

This does not cover damage caused by installation, misuse, alteration, accident, ground movement, or ordinary wear and weathering.

12. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or relating to any product or order is limited to the amount you paid for that product. We are not liable for indirect, incidental, special or consequential losses, including loss of profit, loss of use, delay costs, or the cost of other work affected by a product or its delivery.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or your rights under applicable Canadian consumer protection legislation.

13. Your account

If you create an account, you are responsible for keeping your credentials confidential and for activity that occurs under your account. Tell us promptly if you believe your account has been compromised.

14. Acceptable use

You agree not to use this site for any unlawful purpose, to interfere with its operation or security, to scrape or harvest data from it, or to attempt to gain unauthorized access to any part of it or to any other user’s information.

15. Intellectual property

The content of this site — including text, product photography, diagrams, logos and design — is owned by us or our licensors and is protected by copyright and trade-mark law. You may not reproduce, republish or use it commercially without our written permission.

16. Third-party links

This site may link to third-party websites. We do not control them and are not responsible for their content, products or privacy practices.

17. Privacy

Our handling of your personal information is described in our Privacy Policy.

18. Changes to these Terms

We may update these Terms from time to time. The version in effect when you place an order governs that order. Changes take effect when posted, and the “last updated” date above will reflect them.

19. Governing law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. The courts of Alberta have jurisdiction over any dispute, without affecting any right you may have to bring a claim in the province where you reside.

20. General

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Shipping Policy, Return Policy and Privacy Policy, are the entire agreement between us regarding your purchase.
